Terms & Conditions

By using Nomado Trails (the website or mobile app), you agree to the following terms:

1. General Disclaimer

  • Nomado Trails acts as a technology platform connecting Hosts and Travellers.
  • We do not own, operate, or control the listed assets (cars, buses, boats, villas, homestays, etc.).
  • All bookings are a direct contractual agreement between the Host and the Traveller.
  • Any disputes, damages, delays, or liabilities must be settled directly between the Host and Traveller.
  • Nomado Trails earns a platform commission and is not responsible for any operational, financial, or legal obligations.

2. Host Policies & Terms

Eligibility to List

  • Only unique, verified, and quality homes/villas are allowed.
  • Hosts must provide ownership/authorization proof for cars, villas, boats, or any listed assets.
  • All listings are subject to internal approval by Nomado Trails before going live.

Listing Responsibilities

Hosts must:

  • Provide accurate information (photos, amenities, rules, rental cost).
  • Keep availability calendars updated to avoid false bookings.
  • Ensure that the asset is safe, clean, and compliant with local laws.
  • Provide required permits, licenses, insurance (where applicable).

Payments & Payouts

  • Travellers pay through Nomado Trails’ payment gateway.
  • Nomado Trails deducts its commission (%) before transferring payouts to the Host.
  • Payouts are released post successful booking completion.

Cancellation & Liability

  • Once a Traveller confirms booking, Host cannot cancel unless in emergency.
  • Damages caused during stay/usage must be settled between Host and Traveller directly.

Nomado Trails is not liable for:

Traveller misconduct.

Property damage.

Legal violations by either party.

3. Traveller Policies & Terms

Booking

  • Travellers must provide accurate details (ID proof, valid license for cars/boats, etc.).
  • Once booking is confirmed & paid, it cannot be cancelled or refunded.
  • Travellers are advised to check Host rules, amenities, and dates before confirming.

Usage & Responsibility

Travellers must:

  • Follow all local laws while using booked assets.
  • Return assets (cars, boats, villas) in the same condition.
  • Respect host property, neighbors, and rules.
  • Any damage, theft, or misconduct will be directly settled with the Host.

Liability

  • Nomado Trails is not responsible for:
  • Safety during travel/stay.
  • Accidents, theft, or damages.
  • Disputes between Host and Traveller.

4. Investor Policies (Fractional Ownership)

  • Nomado Trails may list fractional ownership investment opportunities in partnership with trusted partners (e.g., Claravest).
  • All investments are at investor’s own discretion.
  • Nomado Trails is not a financial advisor and does not guarantee returns.
  • Investors are requested to read all asset ownership terms before committing.

5. WhatsApp Support Policy

Travellers, Hosts, and Investors can connect via Nomado Trails WhatsApp Chat Support for:

  • Booking queries.
  • Payment status.
  • Technical assistance.

Dispute resolution will not be handled on WhatsApp – must be directly between Host & Traveller/Investor.

6. Booking & Payment

  • All bookings are subject to availability.

  • Full/partial payments may be required in advance.

  • Payment gateways used are secure, and Nomado Trails does not store your card info.

7. Cancellation & Refund

At Nomado Trails, transparency and fairness are at the core of our operations. Since we work as an aggregator platform, we facilitate bookings and investments but do not hold liability for disputes. The responsibility for refunds or cancellations lies directly between Hosts and Travellers, while Investors’ returns are governed by fractional ownership agreements.

For Travellers (Guests)

1. Booking Confirmation

Once a traveller confirms and pays for a booking, it is non-cancellable and non-refundable.

Travellers are strongly advised to check availability and mark their calendars before confirming a booking.

2. Host-Initiated Cancellation

If a host cancels after accepting a booking, the traveller will receive a 100% refund of the booking amount.

Any further claims (like compensation for inconvenience) must be settled directly between the host and traveller.

3. No-Show Policy

If a traveller does not show up on the booking date, no refund will be issued.

4. Force Majeure (Unforeseen Circumstances)

In rare cases such as natural disasters, government restrictions, or unavoidable events, refunds will be at the discretion of the host. Nomado Trails is not responsible for such decisions.

For Hosts

1. Listing Commitments

Hosts must ensure accurate property/vehicle details, pricing, and availability.

Once a booking is confirmed, the host cannot cancel except in unavoidable circumstances.

2. Cancellations by Host

Frequent cancellations by a host may lead to penalties, reduced visibility in search results, or suspension from the Nomado Trails platform.

Refunds for host cancellations must be processed to the traveller within 7 business days.

3. Refund Liability

Nomado Trails does not process refunds on behalf of hosts. Hosts are directly responsible for settling refund-related issues with travellers.

For Investors (Fractional Ownership Model)

1. Investment Refunds

Investments in fractional ownership properties are non-refundable after the agreement is signed and payment is processed.

2. Exit Policy

Investors wishing to exit can only do so by selling their share as per the terms outlined in the Fractional Ownership Agreement.

Nomado Trails or its partners (e.g., Claravest) may provide a secondary marketplace or buyer matching, but refunds are not guaranteed.

3. Returns & Income

Rental income or capital appreciation will be distributed as per the investment agreement.

Nomado Trails does not guarantee returns and is not liable for market risks.

General Notes

  • All disputes regarding refunds/cancellations are to be resolved directly between the Host and Traveller/Investor.
  • Nomado Trails acts only as a technology aggregator and channel partner and cannot be held liable for financial losses, service disputes, or policy breaches by hosts or travellers.
  • By using our platform, all users (Hosts, Travellers, and Investors) agree to abide by this Refund & Cancellation Policy along with our Terms & Conditions and Privacy Policy.

8. Responsibility & Conduct

  • You are responsible for accurate info during booking.

  • You must respect the host property rules and local laws.

  • Nomado Trails is not liable for any misconduct, injury, theft, or delay caused by third-party vendors.

9. Changes or Cancellations by Provider

  • In case of emergencies or force majeure, vendors may cancel or reschedule. We will provide alternatives or refunds where applicable.

10. Intellectual Property

All content on the site, including the Nomado Trails logo, is copyrighted. Reproduction without permission is prohibited.

11. Limitation of Liability

Nomado Trails shall not be liable for indirect or consequential losses due to vendor cancellations, errors, or acts of God.

12. Jurisdiction

These terms are governed by Indian law. Any disputes shall be resolved under Pune jurisdiction.
